Terms and Conditions

1. Agreement

These Terms and Conditions ("Terms") govern your use of the Noticeable Web Design website at noticeable.com.au and the purchase of web design, logo creation, imagery, hosting, and domain services ("Services") provided by Noticeable Web Design ("Noticeable", "we", "us", "our").

By using our website or purchasing our Services, you ("Client", "you") agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Services.

These Terms comply with the Australian Consumer Law (ACL) as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).


2. Services

2.1 Web Design Packages

Noticeable offers three web design packages as described on our website:

  • Starter — up to 5 pages, AI-generated logo and imagery, basic SEO, contact form, hosting setup included
  • Business — up to 12 pages, full on-page SEO, CMS, hosting setup included
  • Growth — up to 25 pages, full SEO with schema markup, e-commerce (up to 50 products), multi-step forms, booking/calendar, hosting setup included

Package inclusions are as described on our Pricing page at the time of purchase. We reserve the right to modify package inclusions with reasonable notice.

2.2 AI-Assisted Delivery

Our Services are delivered using artificial intelligence tools including language models, image generation systems, and automated code generation platforms. By purchasing our Services, you acknowledge:

  • Websites, logos, and imagery are generated by AI systems based on the brief information you provide
  • Delivery timeframes (approximately 24–72 hours depending on package) are estimates and may vary
  • AI-generated outputs are reviewed by our automated quality system; human review may occur but is not guaranteed on every project
  • The quality and accuracy of outputs depend substantially on the completeness and accuracy of the brief you provide

2.3 Hosting and Domain Services

Hosting and domain registration are charged separately from the build fee. By purchasing hosting or domain services:

  • Domain registration is subject to the terms of our domain registrar partner (Synergy Wholesale) and applicable registry policies
  • Hosting services are provided on a monthly or annual basis and renew automatically unless cancelled
  • We reserve the right to suspend hosting services for non-payment after 7 days written notice
  • Domain names are registered in the Client's name; Noticeable acts as the administrative contact only

3. Brief Intake and Client Responsibilities

3.1 Accuracy of Brief

You are responsible for providing accurate, complete, and lawful brief information. Noticeable is not liable for outputs that fail to meet your expectations due to incomplete, inaccurate, or misleading brief information.

3.2 Client-Supplied Content

If you supply your own images, text, logos, or other content, you warrant that:

  • You own or have the right to use all supplied content
  • The content does not infringe any third-party intellectual property rights
  • The content is not defamatory, offensive, or unlawful

You indemnify Noticeable against any claims arising from client-supplied content.

3.3 Approval

Upon delivery of your completed website, you have 5 business days to review and request your included revision round. After 5 business days without feedback, the project is deemed accepted.


4. Revisions

4.1 Included Revisions

  • Starter and Business packages include 1 round of revisions
  • Growth packages include 2 rounds of revisions

A revision round means one consolidated set of change requests submitted at one time. Each revision round must be submitted within 5 business days of receiving the deliverable.

4.2 Additional Revisions

Additional revision rounds beyond those included are available at $149 per round. Requests for additional revisions must be submitted within 30 days of original delivery.

4.3 Scope of Revisions

Revisions cover amendments to the design, content, layout, and functionality within the scope of the original package. Requests that materially expand the project scope (e.g., adding pages, adding e-commerce functionality not included in the package) will be quoted separately.


5. Intellectual Property

5.1 AI-Generated Content

Upon full payment, you receive a non-exclusive, worldwide licence to use all AI-generated outputs (website code, logo, imagery) delivered as part of your project. You acknowledge that:

  • AI-generated content may not qualify for copyright protection under Australian law, as current legislation generally requires human authorship
  • Noticeable makes no warranty that AI-generated logos or imagery are unique or free from similarity to other AI-generated works
  • We recommend you conduct your own trade mark search before using a generated logo as a registered trade mark

5.2 Client-Supplied Content

You retain ownership of all content you supply to us.

5.3 Noticeable Platform

The noticeable.com.au platform, including its brief intake system, automation pipeline, and design templates, remains the intellectual property of Noticeable Web Design.

5.4 Portfolio Rights

We reserve the right to display completed client websites in our portfolio, unless you request otherwise in writing at the time of project completion.


6. Payment

6.1 Fees

Fees are as listed on our website at the time of purchase. All prices are in Australian dollars (AUD) and are inclusive of GST where applicable.

6.2 Payment Terms

Payment is required in full before work commences. Work will not begin until payment is confirmed. Payment is processed securely via Stripe.

6.3 Hosting and Domain Renewals

Hosting and domain fees are charged on a recurring basis (monthly or annually as selected). You authorise us to charge your nominated payment method for renewals. We will provide at least 14 days notice before any price increase takes effect.


7. Refunds and Consumer Guarantees

7.1 Australian Consumer Law

Our Services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a refund or replacement for a major failure and to compensation for other reasonably foreseeable loss or damage. You are also entitled to have the Services remedied if they are not of acceptable quality and the failure does not amount to a major failure.

7.2 Refund Policy

  • If work has not commenced, you are entitled to a full refund upon written request
  • If work has commenced but has not been delivered, a partial refund may be issued at our discretion, less the value of work completed
  • Once a completed website has been delivered, refunds are not available unless the deliverable contains a major failure as defined under the ACL
  • Hosting fees are non-refundable for the current billing period once access has been provided
  • Domain registration fees are non-refundable once a domain has been registered with the registry

7.3 Requesting a Refund

To request a refund, contact us at support@noticeable.com.au with your order number and a description of the issue. We will respond within 5 business days.


8. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability to you for any claim arising from our Services is limited to the fees you paid for the relevant Service
  • We are not liable for any indirect, incidental, consequential, or special loss or damage, including loss of profits, loss of data, or loss of business opportunity
  • We are not liable for downtime, data loss, or service interruptions caused by third-party hosting, domain, or infrastructure providers
  • We are not liable for the accuracy, originality, or suitability of AI-generated content for your specific business purpose

Nothing in these Terms limits or excludes any right or remedy you have under the ACL that cannot be excluded by law.


9. Disclaimer

9.1 AI-Generated Content

Noticeable uses AI tools to generate website content, logos, and imagery. While we take reasonable steps to ensure quality, we do not warrant that:

  • AI-generated content is error-free, accurate, or fit for any particular purpose
  • AI-generated imagery or logos do not resemble third-party works
  • AI-generated website copy is factually accurate (you should review all copy before publishing)

9.2 Search Engine Rankings

We do not guarantee specific search engine rankings or traffic outcomes from our SEO services. SEO results depend on many factors outside our control.

9.3 Security

While we implement reasonable security measures, we do not warrant that our platform or hosted websites will be free from security vulnerabilities or breaches.


10. Termination

10.1 By Client

You may terminate ongoing hosting or maintenance services with 30 days written notice to support@noticeable.com.au. You will remain responsible for fees accrued to the date of termination.

10.2 By Noticeable

We may suspend or terminate your account and services immediately if you:

  • Breach these Terms and fail to remedy the breach within 7 days of written notice
  • Use our services for unlawful, harmful, or abusive purposes
  • Fail to pay fees when due

Upon termination, you are responsible for migrating your website and domain. We will provide reasonable assistance for up to 30 days post-termination.


11. Governing Law

These Terms are governed by the laws of Tasmania, Australia. Any disputes will be subject to the non-exclusive jurisdiction of the courts of Tasmania.


12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of our Services after that date constitutes acceptance of the updated Terms.
